Risk Management in Projects

“It is the beginning of our financial year and we are already having a dispute with a client and it looks like we will not get paid all the money due on the project!”

Is this a depressing and familiar story?

Have you been involved in resolving disputes with clients, settling claims, writing off debts or fighting with your subcontractors or suppliers? Did projects start off being profitable and then turn into loss making nightmares? Have you been involved in litigation and come to the conclusion that the only winners seem to be the lawyers?

These types of problems occur in all organizations which deliver services and carry out projects for their clients. They are frustrating, take up a lot of management time as well as costing a lot of money!

Often if you go back in time to when the opportunities first appeared and contract negotiations commenced, you can see where the problems first took root and then as time passed problems just multiplied!

Prevention is better than cure –identify, assess and manage the risks. Effective risk management is a fundamental part of good governance. HJ Legal can provide training to increase awareness and improve understanding of the commercial and legal risks that can impact your projects and business. For example, the Prevention is Better than Cure workshop can be provided.

Procurement and Supply Chain Management

“We are in the process of putting together tender documents so that we can start the procurement process to find a suitable contractor. We want to find a contractor who delivers value for money and who understands our vision and requirements. There have been some problems in the past with contractors and suppliers working on our major projects. We want to make sure that we get the procurement process right this time so that we can avoid past mistakes.”

No one plans for failure but poor planning and lack of consideration of relevant risks can lead to costly and poorly executed projects and services. The purchasing or procument process is a fundamental element of any contract or project. An effective procurement process will encompass (amongst other things) proper planning, consideration of relevant risks, well drafted contracts and clear communication of the project requirements to suppliers and contractors.HJ Legal can provide training to help improve legal risk management in your procurement process. See the details of the Procurement Matters workshop as an example of a workshop which can be provided.

Continuing Professional Development (CPD)

“As my career developed, I gradually became involved in dealing with contract negotiations and managing projects. It is important that prof itable projects are delivered within budget and on time which meet our clients requirements. I have learnt a lot on the job however there are some gaps in my knowledge and I need to improve in those areas.”

Developing the skills and broadening the knowledge of employees enables a business to be successful by providing competent people to deliver professional services and maintain standards. Continuing professional development (CPD) is key part of maintaining standards and competence. “Learning on the job” is a great method of acquiring practical skills and experience and can be part of CPD. However relying solely on “learning on the job” is not sufficient as jobs in the modern working environment become more complex and demanding. Targeted and specific training is also required which is aimed at acquiring specific skills and knowledge. This type of training can form a valuable and key part of CPD. HJ Legal can provide in-house training to assist employees with their CPD. For example, the Business Basics-Contracts and Copyright workshop could be provided to employees who need a comprehensive introduction to contract and copyright law
